The purpose of this document is to establish the General Conditions of Use of findtutors.co.uk (hereinafter "FindTutors"), owned by TUS MEDIA S.L. (hereinafter "Tus Media"), registered in the Mercantile Registry of Barcelona: Volume 42792, Folio 111, Page B413067, with a registered office at Pallars, 3-5 Palau B 3º 2ª, 08402 Granollers, Barcelona (Spain) and Tax Identification Number B65640930.
These General Conditions of Use do not exclude the possibility that some of the contents and/or services of FindTutors have their own specific conditions of use. Therefore, and in case you agree to provide or use different services through the Tus Media platforms, there will be the possibility that you will have to accept different versions of the general conditions of use or other agreements.

Aim of FindTutors
FindTutors is an online intermediation online platform (the "Platform") accessible through the website "findtutors.co.uk" (the "Website"), which allows internship or language exchange providers (the "Teachers" and/or “Educational Centers”) to upload advertisements offering training in various areas and recipients of internships or language exchanges (the “Students”) to request training in the areas offered. Tutors and/or Educational Centers and Students will be jointly referred to as users (the “Users”). FindTutors never provides any type of training service, either directly or indirectly, to its Users.
These General Conditions regulate the use of the Platform between Teachers or Educational Centers and Tus Media, and apply to all natural or legal persons registered as Teachers or Educational Centers on the Platform. If you are a legal entity, to use the Platform and enjoy the services, you accept, on behalf of and on behalf of the entity you represent, without restriction or reservation, to be bound by these General Conditions of Use, as well as, by any other specific conditions that regulate certain services of the Platform, and by the rules and/or policies published on the Website.
The access and registration of any Teacher or Educational Center on the Website implies knowledge and acceptance of these General Conditions of Use.
Responsibility of Teachers and/or Educational Center
The Tutor and/or Educational Center is fully responsible for the access and correct use of FindTutors subject to current legislation, whether national or international, as well as the principles of good faith, morality, good customs and public order. In particular, you agree to diligently comply with these conditions of use.
Teachers and/or Educational Centers will refrain from using the services and contents of FindTutors for illicit purposes or intentions that are harmful to the rights and interests of third parties, or that in any way may damage, disable, affect or deteriorate FindTutors, its content and its services. Likewise, it is prohibited to prevent the normal use or enjoyment of FindTutors to other Users.
Tus Media is not responsible for the use that third parties may make of the data provided through this Website. Those who fail to comply with such obligations will be liable for any loss or damage caused. Tus Media will not be liable for any consequence, damage or harm that may arise from said access or illicit use by third parties.
Tus Media will not be responsible for the veracity of the data provided by the Teachers and/or Educational Centers of the Website, not being responsible in any case for the lack of veracity in data published by Users in FindTutors.
In general, the Teacher and/or Educational Center undertakes, by way of example and without limitation, to:
- Not use FindTutors for illegal or unauthorized purposes. Tus Media is committed to the fight against the dissemination of terrorist content;
- Not alter or modify, totally or partially, FindTutors, circumventing, deactivating or manipulating in any other way the functions or services of FindTutors;
- Not infringe industrial and intellectual property rights or the regulations governing the protection of personal data;
- Not use FindTutors to insult, defame, intimidate, violate one's own image or harass other Users;
- Not publish any comment or piece of information that is illegal, racist, xenophobic, obscene, pornographic, abusive, defamatory, misleading, fraudulent or in any way contrary to morality or public order on FindTutors;
- Not access the email accounts of other Teachers and/or Educational Centers and of the people registered as Students;
- Not send mass and/or repetitive emails to a plurality of people, nor send email addresses of third parties without their consent.
- Not use FindTutors' contact forms, to send commercial communications not previously consented by the other Users of FindTutors.
- Not use FindTutors as a directory to obtain contact information of the Users to carry out commercial actions or send commercial communications not previously consented by the Users.
The Teachers and/or Educational Centers are the only ones responsible for being correctly registered in the corresponding professional activity for the services provided to the Users, therefore, Tus Media is not responsible and is completely exempt from obtaining the authorizations that the Teachers need.
By registering on findtutors.co.uk, the Teachers and/or Educational Centers declare and guarantee to Tus Media that they comply with the legal and fiscal obligations derived from their professional activity.
Nothwithstanding the above, Tus Media reserves the right to deny access to findtutors at any time to Teachers and/or Educational Centers that fail to comply with these General Conditions of Use in accordance with the provisions of the section on Resolution and Termination of the General Conditions of Use. In this sense, Tus Media may eliminate the profile, advertisement or comments of any Teacher and/or Educational Center that fails to comply with the obligations set out in our Content Removal Policy.
In any case, Tus Media will not be responsible in case of (i) any losses and/or direct and/or indirect, consequential and/or punitive damages, as well as of any other nature, caused to the Users or to third parties derived from the services , as well as any other activities, direct or indirect, carried out by and/or through the Platform; (ii) business losses (including, but not limited to, decrease in income and/or expected savings, termination of contracts, loss of goodwill or unnecessary expenses incurred); (iii) loss of business reputation; (iv) loss of any data responsibility of the Users; (v) as well as, in no case will Tus Media have any responsibility for the loss of profits.
Tus Media will not be responsible for any delay or lack of compliance with its obligations derived from these General Conditions of Use if said delay or lack of compliance is attributable to circumstances beyond the reasonable control of Tus Media. Likewise, Tus Media does not assume any responsibility for obligations that are applicable to Teachers and/or Educational Centers under regulations governing their activities.
Rules regarding the publication of advertisements
The violation or non-compliance with any of the following points will result in the removal of the ad:
Contact data, such as: telephone numbers, web pages or email addresses, may not be written or displayed in the fields of: title, name, location, description, photograph or video of the advertisement. Such data shall be entered in the specific fields reserved for this purpose.
The announcements must be relevant to the theme of FindTutors, the following, for example, is not accepted: purchase or sale of products, financing, rental of spaces, etc.
All training centers, understood as such: academies, schools, educational centers, associations, training or consulting companies, professionals with an establishment that serves the public, groups of teachers or tutors that use a brand/commercial name and not their name, must previously register as educational centers (the “Educational Centers”). Each Teacher and/or Educational Center that has validated their telephone number will be able to publish up to a maximum of 3 free announcements in different subjects. The use of alternative email addresses to increase the number of published announcements is not allowed.
The advertisements may not plagiarize the literal content of other advertisements published on the website.
Content Removal Policy
Tus Media has established mechanisms for detecting and removing from the Website or the Platform, any content that may be considered illegal. This content includes, but is not limited to, content linked to the impairment of personal rights, the violation of any intellectual property rights, activities of a defamatory nature, the security of the services offered by Teachers and/or Educational Centers, incitement of hatred, terrorism, as well as any other content that without being considered illegal are not adequate or appropriate to the Website or the Platform in which they have been published. In the event that Tus Media becomes aware of the existence of illegal content, we will proceed to analyze the request and, where appropriate, proceed to its immediate withdrawal.
If the Teacher and/or Educational Center detects any kind of illicit or inappropriate content on this Website or on the Platform, please notify us, without undue delay, through the following email address: legal@tusmedia.com. We will analyze the information or communication as soon as possible and, where appropriate, we will proceed to withdraw it promptly. In the event that it is necessary, either because of the information provided, indications or knowledge of the commission of any criminal offenses or because of any other reason, we will inform the relevant authorities.
In any case, in the event that we proceed to remove any illegal or inappropriate content from the Website or the Platform, we will inform the Teacher, the Educational Center or the third party that has hosted such information, and they may oppose the decision to withdraw the content by Tus Media. Teachers, Educational Centers or third parties will have a period of five [5] calendar days to exercise their right to object and present their allegations to Tus Media at the following email address: legal@tusmedia.com. Once your allegations have been verified, Tus Media will proceed to respond to you as soon as possible, indicating the decision adopted.
Development of the activity of Teachers and/or Educational Centers
These General Conditions of Use define the conditions under which Tus Media makes the Platform available to the Teacher and/or Educational Center. Students may use the Platform to contact Teachers and/or Educational Centers by sending messages or in some cases by making phone calls (after requesting to view the telephone number of the Teacher and/or Educational Center). In both scenarios, Tus Media will provide the necessary data so that the Teacher and/or Educational Center can respond or contact the interested Student.
Tus Media is not aware of and is not responsible for the economic, employment and/or any other type of relationship established between the Users of FindTutors. Tus Media only offers Users a Website where they can establish contact, without being responsible for the content of said contact. Tus Media does not access the content of the emails between the Teachers and/or Educational Centers and the Students. Any activity that derives from said contact is under the exclusive responsibility of the Teachers and/or Educational Centers and the Students.
Tus Media does not guarantee that the contacts between the Users of FindTutors, whether by telephone or via e-mail, will be answered. The Teachers and/or Educational Centers are solely responsible for opening and answering the queries they receive from the Students.
Tus Media does not know and is not responsible for the educational method, content, as well as the material used in the classes taught. These aspects must be agreed only between the Users.
Tus Media does not know nor is it responsible for the place where the activity takes place or for compliance with the schedules agreed by the Users for the development for the exchanges, practices and/or private classes.
Tus Media does not know or guarantee the technical capabilities of the Teachers and/or Educational Centers, nor does it have a way of controlling that they are professional teachers, or that they comply with the legal and fiscal regulations related to its activity.
Student Ratings
Students may assess the services provided by Teachers and/or Educational Centers through FindTutors free of charge, without these assessments implying any responsibility for Tus Media and for which the Student undertakes to hold Tus Media harmless for any claim that it may receive from Teachers, Educational Centers and/or any third party derived from such events.
Tus Media moderates the comments so that these in no case imply an attack against morality, harm public order or could be humiliating in accordance with our Content Removal Policy. In particular, Tus Media will not answer queries related to said service through the telephone service.
Balance service
The Teachers and/or Educational Centers can insert money into their FindTutors account to later use it to contract the following services: upload ads and highlight ads. The inserted money does not expire, so the money will be kept in their FindTutors account.
The balance can only be used for the services offered by FindTutors, and the money cannot be returned again. In the event that the Teacherand/or Educational Center wants to unsubscribe from the services of the Website and has a balance, this will not be returned.
The activation of any subscription service through the use of balance (be it featured ads or Verified Teacher, a TusMedia premium service available on the platform), implies the acceptance of being regularly charged for this service through the Teacher and/or Educational Center's balance, as long as the account has enough balance, and if not, through the use of the card linked to the balance top-up.
The rest of the conditions are the same that apply to any other payment method.
Featured Ad Service
When you subscribe to FindTutors to receive classified services, your classification will be calculated based on the date of your registration on the platform. That is, the most recent record will receive the highest ranking and the oldest record will receive the lowest. Notwithstanding the above, it will be possible to increase the time and frequency of appearance in the search engine by purchasing a premium product. The purchase of a premium product allows the configuration of the frequency, duration and term of said appearance in the search results. Once again, the registration date will define the order of the search results. However, when purchasing products you will receive a new date stamp, which will ensure higher visibility in search results.
The duration of the service is 30 calendar days. During the aforementioned period, the ad will appear highlighted in blue in the FindTutors search engine, and it will automatically move up the rankings every 4 days. However, in providing these services, TusMedia cannot guarantee or promise a specific success rate. The impact of the advertisements displayed will depend on both the region in which they are displayed and the area in which the tutorials or other services are provided. For example, the demand for English classes tends to be on average higher than the demand for religion classes. As a consequence, this may directly impact the results generated by the use of TusMedia services.
The subscription will be automatically renewed each month and the amount will be charged to the card of the Teacher and/or Educational Center. In the event that the Teacher and/or Educational Center has a sufficient balance, the balance will be used to avoid making a charge on the card.
The Teacher and/or Educational Center may cancel the renewal of the service at any time from the Configuration area of their personal area. If the Teacher cancels the subscription up to 3 days before the next renewal date, the service will not be renewed. In case of cancellations during during the last 3 days of the service, Tus Media will renew the subscription for one more month and the service will be canceled the following month.
The card data for the activation of any subscription service or for uploading balance will be collected in encrypted form collected by Redsys Servicios de Procesamiento SL. (“Redsys”), who is in charge of remote electronic payment operations. You can find the Redsys privacy policies here and the terms of use here.
Redsys Processing Services. SL., will store and process said data autonomously to make purchases in FindTutors.
Tus Media reserves the right to suspend or terminate the use of the service if the Teacher and/or Educational Center does not comply with these Conditions, or if the use of the service causes legal responsibilities.
The price of the Featured Ad service for Argentina will be reviewed monthly, so the price for new hires and for active subscriptions will be updated according to the Consumer Price Index IPC published here.
Particular conditions of the Verified Teacher service
The duration of the service is 365 days from the date of contraction. When contracting the service, its auto-renewal is activated, so that every 365 days the fee for the Verified Teacher service will be charged again at the amount in force at that time. You can cancel the auto-renewal of the service at any time from the account settings.
To contract the service it is necessary to have the following requirements:
- Reside in the United Kingdom.
- Have a British mobile phone number.
- Be a private teacher with students or former students. Once the service has been contracted, in order to enjoy its advantages, the following requirements must be met:
- You must verify the phone number through an SMS. This SMS has no additional cost.
- You must have reviews on the profile or get at least one student or alumni to make a review.
- You must have a real and close-up photo in the profile.
Redsys Processing Services. SL., will store and process said data autonomously to make purchases in FindTutors, you can access the Terms and Conditions of Redsys Processing Services. SL In the following link.
If you wish to cancel the Verified Teacher service, you must do so at least eight (8) business days in advance, since the charge is made 7 days before the renewal of the service.
Visibility Service: Jump Package
The Teacher and/or Educational Center may hire upload packages or bonuses, which allow the Teacher and/or Educational Center's advertisements to be individually uploaded to the top positions of the FindTutors search engine. The packages have a maximum duration of ninety (90) calendar days from the date of contraction.
Sending advertising information to the email address of the Teacher and/or Educational Center
Registration as a FindTutors Teacher and/or Educational Center, access to our management areas, or the use of our Student contact forms (by email or request to view the telephone number), implies the express authorization for the sending of commercial and advertising information by Tus Media. If you wish to revoke said authorization, you can do so at any time through our contact form www.findtutors.co.uk/help/
Potential Students
Teachers and/or Educational Centers subscribed to the Verified Teacher service will have the chance to contact students who have not received responses to messages they have sent to other teachers contacted through the Potential Students service.
When you pay for this service, you are paying to have access to students who wish to be contacted. Once the service has been contracted and the student has been contacted, FindTutors will not be held responsible if the student does not respond or subsequently unsubscribes from the portal.
Accessibility
The Teacher and/or Educational Center is responsible for having the necessary services and equipment for browsing the Internet and for accessing FindTutors. In the event of any incident or difficulty in accessing the Website, the Teacher and/or Educational Center can inform Tus Media at info@findtutors.co.uk. We will proceed to analyse the incident and give instructions to the Teacher and/or Educational Center about how to solve the issue in the shortest possible time.
Tus Media will not be liable in the event of service interruptions, connection errors, lack of availability or deficiencies in the Internet access service, nor for interruptions in the Internet network or for any other reason beyond the control of Tus Media.
In particular, Tus Media does not guarantee the inexistence of the interruptions described in the previous paragraph in the United Kingdom, nor does it guarantee the operability of the telephone attention service for this country.
Likewise, Tus Media will not be liable for the acts or omissions of third parties, regardless of whether these third parties may be linked to Tus Media by contractual means.
Link policy
Tus Media does not assume any responsibility derived from the linked contents (Links) that enable the Teacher and/or Educational Center to access benefits and services offered by third parties through FindTutors, provided that they are unrelated to Tus Media. Therefore, Tus Media is not responsible for the information contained therein or for any effects that may arise from said information. If any Teacher, Educational Center or third party observes that such links may be contrary to law, morality or public order, they must inform us through the email info@findtutors.co.uk.
Intellectual property
The Teacher and/or Educational Center waives the use of any of the materials and information contained in FindTutors to carry out illicit or criminal activities and/or activities that violate the regulation of intellectual and industrial property, or any other norm of the applicable legal system.
The authorisation given to the Teacher and/or Educational Center to access the Website does not imply a waiver, transmission or total or partial transfer of intellectual or industrial property rights by Tus Media. In order to rule out any possible doubt, teachers and educational centers will not be allowed to make use of the intellectual or industrial property rights, any other third party rights, nor rights of the provider of the platform or of third parties external to the platform. Nor may they make use of the aforementioned rights for any other purpose other than that stipulated in this contractual relationship.
It is not allowed to delete, evade or manipulate in any way the contents of the Tus Media Website. Likewise, it is forbidden to modify, copy, reuse, exploit, reproduce, publicly communicate, make second or subsequent publications, upload files, send by mail, transmit, use, treat or distribute in any way all or part of the contents included in the Tus Media website for public or commercial purposes, if you do not have the express written authorization of Tus Media or, where appropriate, the owner of the corresponding rights.
Privacy Policy
Teachers are informed that all personal data provided to Tus Media under these General Conditions of Use, as well as those that may be generated by the use of the intermediation service provided by Tus Media, will be treated by Tus Media, as Data Controller, for the purposes of executing and managing this contractual relationship and, where appropriate, complying with the legal obligations required. Teachers may exercise their rights of access, rectification, deletion, limitation to treatment and opposition by contacting Tus Media at the address indicated in the heading of these General Conditions of Use. Affiliated companies
By accepting these General Conditions of Use you accept that Tus Media, S.L. (“Tus Media”), as data controller, communicate your personal data (identification data, telephone number, email as well as any other information provided in your public profile, such as the subjects you teach or the curriculum vitae, if any) to GoStudent GmbH and its subsidiaries listed here, so that these entities can send commercial communications by telephone and/or email.
You may withdraw your consent at any time by writing to the postal address of Tus Media (Calle Pallars 3-5 Edificio B, 3-2, 08402 Granollers, Spain) or to the email privacy@tusmedia.com.

Updating and Modification of FindTutors
Tus Media reserves the right to modify these General Conditions of Use at any time in order to adapt them to current applicable legislation, new jurisprudence and usual market practices.
Tus Media reserves the right to modify, at any time, these Conditions of Use. Likewise, Tus Media reserves the right to make, at any time, updates, modifications or elimination of information contained on its Website, in the configuration and presentation of this information and the conditions of access, without assuming any responsibility for it beyond what is established by the applicable legislation. Tus Media will notify the Teachers and/or Educational Centers fifteen (15) calendar days before any change in these General Conditions of Use via email.
Tus Media reserves the right to make changes to the General Conditions of Use that are effective immediately when any of the following circumstances occur: (1) when necessary due to legal or security requirements; (2) when it results from any variation or adjustment of a technical nature in the Platform or Website, in the service itself or, where appropriate, in the additional services; (3) when the change corresponds to the elimination or modification of elements that, in the opinion of Tus Media, are harmful to security or are illegal, offensive, inappropriate or discriminatory and/or (4) when it is necessary to deal with an unforeseen and imminent danger related to the defense of online intermediation services, Students or Teachers and/or Educational Centers against fraud, malicious computer programs, spam, data security breaches or other cybersecurity risks.
Minors
In general, to make use of FindTutors services, minors must have previously obtained the authorization of their parents, guardians or legal representatives, who will be responsible for all acts carried out through FindTutors by minors in their care. In those services in which it is expressly indicated, access will be restricted solely and exclusively to people over 18 years of age.
Processing of claims
Tus Media makes this email address available to Teachers and/or Educational Centers to process their claims. These claims will be processed by Tus Media within a reasonable period of time and will be treated in a proportionate manner in relation to their importance and complexity.
Resolution and Termination of the General Conditions of Use
The provision of services and content offered in FindTutors has an indefinite duration.
Teachers and/or Educational Centers may unsubscribe at any time through the Platform, through the link available in the account settings or through the link provided at the bottom of the emails they will receive from TusMedia. By unsubscribing, the contractual relationship derived from these General Conditions of Use will cease to have effect (except in relation to those clauses that can be deduced to have effects even after the termination of the contract).
By way of example and without limitation, the conduct described below will be considered breaches of the General Conditions of Use: (i) Making inappropriate or fraudulent use of the Website or the Platform that in any way violates the intellectual property rights of Tus Media or the Teachers; (ii) Use the Platform for purposes not permitted by the applicable regulations or laws or by these General Conditions of Use; and/or among others, (iv) any breach of the General and/or specific Conditions of Use.
If Tus Media decides to end the provision of all its online intermediation services with a Teacher and/or Educational Center, it will provide them a statement of the reasons justifying the decision via email at least thirty (30) calendar days before the termination takes effect.
In the event of Termination, Tus Media will offer the Teacher and/or Educational Center the opportunity to clarify the facts and circumstances causing the termination by completing the claim form here: www.findtutors.co/help/. If the termination is revoked by Tus Media, Tus Media will reinstate the Teacher and/or Educational Center without undue delay.
Tus Media may terminate or suspend the service in cases in which these General Conditions of Use are breached by Teachers without it being necessary to comply with the previously indicated notice period, and only in the following cases: (i) it is subject to a legal or regulatory obligation that requires Tus Media to terminate or restrict the provision of all intermediary services to a Teacher and/or Educational Center in a way that does not allow us to respect the stipulated notice period; (ii) exercises its right to terminate the service for a compelling reason under a national law; and/or (iii) the affected Teacher and/or Educational Center has repeatedly violated the applicable General Conditions of Use. In these cases, Tus Media will provide the Professor and/or Educational Center affected, without undue delay, a statement of the reasons that justify the decision. However this will not apply if Tus Media is subject to legal or regulatory obligations that prevent the communication of specific facts, circumstances or reasons that have caused the termination or suspension of the services or if the service is terminated due to repeated infraction of the General Conditions of Use by the Teacher and/or Educational Center, provided that Tus Media can prove such violation.
Applicable legislation
The General Conditions of Use and the rest of the legal conditions of FindTutors are governed in each and every one of its extremes by Spanish law.
All matters relating to FindTutors are governed by Spanish law and are subject to the jurisdiction of the Teacher and/or Educational Center's domicile. In the event that the Teacher and/or Educational Center resides outside of Spain, Tus Media and the Teacher and/or Educational Center submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of the city of Barcelona (Spain).
Refund Policy
Our services do not offer refunds as they are services that are used automatically at the time of payment. So you have already made use of the service by positioning your profile on our platform and obtaining a benefit from it after payment. For this reason we cannot offer a refund as the service has already been used at the time of purchase of the service.
